Meeting Minutes
September 14, 2026
Those in attendance: President Rob Shipp, Vice President Kevin Hertzler, Council members Rich Fegley,
Tim Ritzman and Donna Showers. Mayor John Kerns, Secretary Karen Knellinger, Plant Manager Jared
Wagner, Plant Operator Brycen Little. Solicitor Bill Dissinger.
President Shipp called the meeting to order at 7:00 pm.
Public and Private Concerns

Mr. Sweger expressed his concern for spending money on a Data Center Ordinance as they would have
only one place to build within the Borough. He feels the County or State will pass legislation to control
where they will be allowed and do not waste the money on it.
The minutes from the regular meeting were emailed and reviewed. Councilmember Ritzman made a
motion to approve the minutes as presented. Councilmember Fegley seconded the motion. Approval
was unanimous.
The bills/receipts/expenditures were reviewed and discussed. Vice President Hertzler made a motion to
approve the bills as presented. Councilmember Showers seconded the motion. Approval was unanimous.
Street Committee Report
All the paving has been completed. The invoice is $3,870 more than the original bid however, after
consultation with Solicitor Dissinger, a clause in the estimate included price fluctuation due to
materials. The escalating price of gas and diesel has driven up the prices on all paving. Their final bid of
$52,620, was still less than the three other bids received. Jared advised all the crosswalks have been
repainted. Complaints have been received on how the state painted Sunbury and Market Streets with a
very sloppy job. Councilmember Showers complained the residents are parking in the yellow no parking
on the corner of Greenwood Street and no visibility to pull out. Jared said he will repaint.

Sewer Committee
Jared advises the pigging of the main took two days and one was stuck so a lot of water was needed to
force through the pipes. A large amount of sludge and grit as well as terra cotta pipe and other debris
was pushed through. This has never been performed on the system since the inception in the 60’s so he
was pretty happy with the result. The basin is still down from the electrical surge in July, repairs are
scheduled for next week. The replacement chiller, ORP and DO probes have been received. Jared has
noticed 12-15 gpm increase and after the impellers and wear plates are rebuilt, he hopes there will be
more of an increase and less run time.
Water Committee Report
The tower was filling for two or three days since the pigging used so much water. Some residents
experienced lower than normal water pressure. Unfortunately, this was an unforeseen circumstance
since a pig got stuck in the main. An engineer bidding offer needs to be drafted for the EPA grant. The
Asset Management Plan is on hold until Jared can catch up with projects and repairs.
Finance Committee Report
A PMRS audit for 2021-2025 is underway by the Pa Auditor General’s Office.
A budget work session will be scheduled for mid-October.
Solid Waste Committee Report
Spring 2027 cleanup is 3/20/27 with a snow date of 4/10/27.
Solicitor’s Report
Solicitor Dissinger advised the Data Centers Ordinance is complete and ready to be advertised; he based
it on a York County model. He will advertise a Planning Commission Meeting at 6:45pm on October 5th
before the Borough Council Meeting and recommend adoption on November 2nd at 7:30pm at an
advertised public hearing for the ordinance. TriCounty and Perry County Planning Commissions have
been consulted for input. Currently, the Borough has no pending applications to be affected.
The Centers can extend across Borough boundaries from surrounding townships. He advises the State is
actually endorsing the Centers; however, local controls may be restored citing the State Supreme Court
may stop them given previous ruling on oil and fracking development. The Centers’ cannot be explicitly
prohibited, however, with the ordinance in place, noise, water usage, setbacks and other concerns are
addressed. They would be limited to the Commercial and Industrial Districts per the Zoning Ordinance.
Council approved the advertising and continue with the Data Center Ordinance guidelines to adopt.

Engineer’s Report
Taz was present since Isaac is on vacation.
Vice President Hertzler made a motion to approve pay request #4 for $15,309.50 and change order #1
final, changing the total contract to be paid to $306,190.00 from $325,140.00 with a difference of -
$18,950.00. Councilmember Showers seconded the motion. Approval was unanimous.
Councilmember Ritzman made a motion to approve the closeout of the project. Councilmember Fegley
seconded the motion. Approval was unanimous.
The plumbing modifications for the pump station has been completed by PSI and an invoice for $15,590
was sent. The force main pigging has been completed by APS on September 9, 2026.
Zoning Permit
Absent – two issues permits for a shed, 11 N Market and a deck replacement and carport, 13 S High.
Mayor’s Report
Senator is having issues with the State Police contacting him about the issue.
Trick or Treat will be Saturday, October 31, 2026 from 6-8pm.
Old Business
Jared researched and found the pipes in the yard of 40 N Market Street has been abandoned since a
newer pipe installed several years ago. He will advise the homeowner.
New Business
Wes Smith is the new EMA director. The Millerstown Park will be selling a small portion to PennDot for
the bridge replacement on West Juniata Parkway.
Stitch in Time is having a yard sale event on 9/19 and will blocking off Spring Street.
Councilmember Ritzman made a motion to adjourn.
Councilmember Fegley seconded the motion. Approval was unanimous.
The next meeting will be held on Monday, October 5th at 7pm.
